These Terms and Conditions govern your use of our automated geospatial analytics platform named Spatiosynth, a software-as-a-service (SaaS) platform. By accepting this agreement, either by clicking a box indicating your acceptance or by executing an order form that references this agreement, you agree to the terms of this agreement. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions, in which case the terms “you” or “your” shall refer to such entity and its affiliates. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this agreement and may not use the services.
1. Definitions
“We,” “Us” or “Our” means the GISKernel Technologies Private Limited (“Company”), a private limited company registered under the Companies Act 2013, and having its Corporate office at Fl-306 Splendour County l8/l2 Nr. Five Garden Rahatani, Pimpri Waghire, Pune, Maharashtra, India, where such expression shall, unless repugnant to the context thereof, be deemed to include its subsidiaries, representatives, administrators, employees, directors, officers, agents and their successors and assigns.
“You”, “Your” or “User” means the Company or other legal entity for which you are accepting this Agreement, and Affiliates of that company or entity.
“User” means your employees who are authorized by You to use the Services, for whom subscriptions to a Service have been purchased, and who have been supplied user identifications and passwords by You (or by Us at Your request)
2. Use of Service
- Eligibility: You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement.
- Account Registration: To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- Subscription Plans: Our Service is offered under various subscription plans. Details of these plans, including pricing and features, are available on our website. By subscribing to a plan, you agree to pay the fees associated with that plan.
3. User Conduct
- User Obligations/ Restrictions:
– If you are buying the report for your own use, then you must not share the report with any other entity.
– You must not use our Service for any illegal purpose.
– You must not violate any laws in your jurisdiction.
– You must not interfere with or disrupt the Service or servers or networks connected to the Service.
– You must not use the Service to build a competitive product or service.
- User Content: You are responsible for all content, including models and assessments, that you upload, post, or otherwise make available through the Service (“User Content”). You grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.
4. Intellectual Property
4.1. Ownership: We and our licensors own all rights, title, and interest in and to the Service, including all software, text, media, and other content available on the Service (excluding User Content).
4.2. Trademarks: All trademarks, logos, and service marks displayed on the Service are our property or the property of other third parties. You are not permitted to use these marks without our prior written consent or the consent of such third parties.

6. Disclaimer of Warranties

These Terms are governed by and construed in accordance with the laws of Maharashtra India, without regard to its conflict of law principles.
